Workers who served on 31 March 1999 retain their rights on the basis of their uninterrupted service status, as stipulated in the agreements mentioned on that date in the previous Scottish APT-C and Manual Worker agreements. In the case of a dispute over the terms of employment between the two parties of the Commission, the dispute, if both parties request it, is referred to CASA for arbitration. The award will be accepted and treated by both parties, as if it were an agreement between the two parties. Employers and trade unions in Scottish local authorities are considering a fair and advanced employment programme to support innovative quality services. This principle will strengthen all Council agreements and activities. Negotiating long-term collective agreements on employment-related issues. 18. Between the date of this circular and April 1, 1999, the status quo applies to normal hours and premium rates, unless it is agreed to introduce the new regime earlier. 9. The assimilation of existing workers to the new backbone is in line with the agreements reached in the Scottish Joint Council. (See item 1.3 of Part 3) The existing spine is presented as an appendix to this section.
4. In addition to this part, the Scottish agreement consists of: promoting and supporting the application of such agreements to local authorities and their employees. 2. From 1 April 1999, the Scottish agreement for former employees of APT-C and Manual will consist of a new manual, known as the Red Book. It will include the following four parts: 23. The CJS recognizes that childminders and caregivers are fully under the new civil registration agreement. However, given the specific characteristics of the terms of service for both groups, the SJC recognises the need for further negotiations in detail before existing agreements can be replaced by the new Scottish Single Status Agreement. 5. Where employment contracts contain Scottish agreements, reference is now made to previous APT-C agreements or manual manuals to the new Red Book. Staff should be informed accordingly and individually and on an appropriate occasion. 6. The new Scottish agreement does not in itself change existing local regulations.
PART ONE – PRINCIPLES 1. The Scottish Joint Council represents Scottish councils and their staff (with the exception of those for which other national negotiating mechanisms exist). Together we are committed to local democratic control of community services as a priority role for local government. Our main task is to reach agreement on a national remuneration system and on the conditions of local application in Scotland, based on our common values. The Constitution of the Scottish Joint Council is attached to Part 3 of this part. The status of the provisions of Parts 2 and 3 is presented in the first part. The second part contains important Scottish provisions, while the third part contains other Scottish provisions which can be amended on the ground through negotiations between the Council and the trade unions.
